December 2, 2022 Opinion or Order Filing 4 NOTICE OF DEFICIENCY AND ORDER: The Court construes Lombrana's letter as a petition for a writ of habeas corpus under 28 U.S.C. 2241. However, Lombrana did not use the court-approved form, nor did he pay the $5.00 filing fee or file an application to proceed in forma pauperis (IFP) with a certificate of his inmate trust account. Thus, if Lombrana agrees with the Court's construction, he must, within 30 days from the date of this order, file a complete amended petition on the court-approved form and either pay the $5.00 filing fee or file an IFP application with a certificate of his inmate trust account. If Lombrana objects to the Court's construction, he must either show cause why the case should not proceed under Section 2247 or file a notice of voluntary dismissal under Federal Rule of Civil Procedures 41, also within 30 days. See Fed. R. Civ P.41(a). If Lombrana fails to comply with this order, the Court may dismiss this action without further notice for failure to prosecute. Additionally, Lombrana must promptly notify the Court of any change of address by filing a written notice of change of address with the Clerk. Failure to file this notice may result in this case being dismissed for failure to prosecute. The Court directs the Clerk to mail Lombrana a Section 2241 form marked "amended," an IFP application, and a certificate of inmate trust account with authorization to Lombrana along with a copy of this order.
