Filing 12 ORDER ADOPTING 1 Complaint filed by Johnny Culp, 11 Findings and Recommendations. After an independent review of the pleadings, file, record, applicable law, and the Magistrate Judges findings and recommendation, the court determines that the m agistrate judges findings and recommendation are correct, and they are hereby accepted by the court. Accordingly, the court dismisses this case without prejudice for want of prosecution pursuant to Fed. R. Civ. P. 41(b). A judgment shall issue separately. (Ordered by Judge Reed C O'Connor on 3/5/2010) (ttm) |
Filing 11 FINDINGS AND RECOMMENDATIONS on case: I find that since the incident about which Plaintiff complains occurred on or about June 8, 2009, dismissal of this case will not result in time barring Plaintiff from filing or re-filing a proper complaint in a proper court. Accordingly, I recommend to the District Court that Plaintiffs Complaint be dismissed without prejudice under Rule 41(b) of the Federal Rules of Civil Procedure for want of prosecution for failure to obey this Courts Order to answer the Courts questions. Magistrate Judge Robert K Roach no longer assigned to case. (Ordered by Magistrate Judge Robert K Roach on 2/18/2010) (aps) |
