Filing 114 Memorandum Opinion and Order. After considering the pleadings and applicable law, the Court GRANTS in part and DENIES in part Defendants Bria, Cates, Goatley, Odom, Szczepinski, Arrieta, Jr., Cerda, Cossey and Morris's Motion for Summary Judgm ent (ECF No. 97). The Court concludes that summary judgment cannot be granted to these Defendants as to Morris's claims for excessive force and bystander liability. The Court does however conclude that summary judgment should be granted to these Defendants as to Morris's claims for retaliation and conspiracy, and for all claims against them in their official capacities.
