Filing 62 MEMORANDUM AND ORDER entered GRANTING 60 MOTION for Reconsideration. The plaintiffs motion for reconsideration is granted. The courts prior grant of summary judgment in favor of the KISD on the as-applied restrictions on student literature distrib ution remains. The prior grant of summary judgment in favor of the KISD on the exclusion of a religious message from the holiday art cards is vacated. This court concludes that based on the record, the KISD did engage in unconstitutional viewpoint discrimination not justified by the interest in avoiding an Establishment Clause violation.
