MEMORANDUM OPINION AND ORDER: all prior decisions in Kenneth Simonss case are VACATED and his case is REMANDED to the ALJ for further proceedings consistent with this opinion. Furthermore, because the BRBs decision in Keith Smiths case followed the BRBs erroneous holding in Simons, all prior decisions in Smiths case are VACATED and his case is REMANDED to the ALJ for further proceedings consistent with this opinion.
