Filing 67 MEMORANDUM AND ORDER. It is ORDERED that Defendants' Motion for Summary Judgment (Document No. 39 ) is GRANTED in part, and Plaintiff Peter J. Paske's federal and state claims for race discrimination and retaliation and retaliation in vio lation of the First Amendment are DISMISSED with prejudice, leaving only the motion on Plaintiff's Texas Government Code, Chapter 614, Subchapter B claim, which is remanded to state court. It is further ORDERED that Plaintiff's sole remaini ng claim, namely, his state law claim that Defendants' termination of Plaintiff's employment was in violation of Texas Government Code §§ 614.021- 614.023, which is also the subj ect of his Motion for Partial Summary Judgment (Doc ument No. 40 ), is SEVERED from this action and REMANDED to the 240th District Court of Fort Bend County, Texas.
