For the reasons stated on the record, the court grants the Children Plaintiffs' motion to lift the stay and the motion to dismiss their claims against the IMC Defendants without prejudice. (Docket Entry Nos. 96, 111). The stay is lifted to permit resolution of the Children Plaintiffs' claims against the IMC Defendants in state court under the saving-to-suitors clause. The IMC Defendants' motion for summary judgment against the Children Plaintiffs is dismissed as moot given that the Children Plaintiffs' claims against them have been dismissed without prejudice. The parties entered into an agreement stipulating that "any and all discovery obtained or exchanged in [this case], whether already accomplished or to be accomplished, [will apply] to any other pending or forthcoming action between the parties." (Docket Entry No. 144). No claims remain as to TTS. By December 4, 2015, TTS will file a motion and proposed order for entry of final judgment as to the claims relating to it under Rule 54(b). The Vessel Defendants' claim for damages against the IMC Defendants remains in this court. This case is administratively closed and stayed. It may be reinstated to the active docket by motion filed within 14 days of the resolution of the Children Plaintiffs' state-law claims against the IMC Defendants. The consolidated case, No. 14-1720, is administratively closed and stayed. It may be reinstated to the active docket by motion filed within 14 days of the resolution of the Children Plaintiffs' state-law claims against the IMC Defendants. The parties will file a proposed order. The scheduling and docket control order is superseded by the stay pending resolution of the Children Plaintiffs' state-law claims. The IMC Defendants may move for and brief certification for interlocutory appeal under Rule 54(b), and the Children Plaintiffs and/or Vessel Defendants may file a response in opposition.
