This dismissal is with prejudice, a s amendment would be futile. Ms. Caldwell's claim arising from a failure to promote is barred by her failure to exhaust administrative remedies within the limitations period. The motion to dismiss is granted as to the state-law claims for fail ure to timely exhaust administrative remedies. This dismissal is without prejudice and with leave to amend if Ms. Caldwell can plead facts showing that she timely filed a discrimination charge with the Texas Workforce Commission.
