Status conference held in this Hurricane Harvey flood insurance case. Docket control order to follow. The Court will not impose a stay of discovery, but the following procedure will apply for the next 60 days, with this process incorporated in the dates chosen for deadlines in this case:1. Plaintiff(s) must promptly provide all documentary and other information remaining due under the Disaster Case Protocols. Plaintiff(s) must provide, upon Defendants informal request, information on matters pertinent to the repairs and status of the condition of the insured property, which information the Protocols did not require. To obtain this information, Defendant may propound specific (not broad, boilerplate) interrogatories or document requests. The information allowed to be requested must be designed to assist Defendant in determining a reasonable settlement position. Plaintiff(s) will provide the information as soon as possible, before the standard 30-day response date under the Federal Rules of Civil Procedure. 2. Defendant is permitted to propound third-party subpoenas to obtain third-party information on repair work performed, materials used, and costs of repair work performed or required. 3. Defendant is allowed to re-inspect the property.4. The parties with their counsel, will participate within the next 60 days in a face-to-face informal mediation (i.e., negotiations) between themselves. Client representatives and adjusters also should be present in person (unless otherwise agreed). Alternatively, the parties may engage in formal mediation with a third-party mediator. 5. Counsel will exchange lists of suggested mediators who are skilled in insurance coverage cases arising from natural disasters. The Court will refer cases to mediation with a magistrate judge only if negotiations have resulted in the parties being less than $20,000 apart for settlement. The parties also are encouraged to use retained mediators (and the magistrate judge) on several cases in a single day, to reduce the cost, per case, of the private mediators.(Signed by Judge Nancy F Atlas) Parties notified.(sashabranner, 4)
