Docket control orderto follow.The Court will not impose a stay of discovery, but the following procedure will apply for thenext 60 days, with this process incorporated in the dates chosen for deadlines in this case:1. Plaintiff(s) must promptly provide all documentary and other information remaining dueunder the Disaster Case Protocols. Plaintiff(s) must provide, upon Defendants informalrequest, information on matters pertinent to the repairs and status of the condition of theinsured property, which information the Protocols did not require. To obtain thisinformation, Defendant may propound specific (not broad, boilerplate) interrogatories ordocument requests. The information allowed to be requested must be designed to assistDefendant in determining a reasonable settlement position. Plaintiff(s) will provide theinformation as soon as possible, before the standard 30-day response date under the FederalRules of Civil Procedure.2. Defendant is permitted to propound third-party subpoenas to obtain third-partyinformation on repair work performed, materials used, and costs of repair work performedor required.3. Defendant is allowed to re-inspect the property.4. The parties with their counsel, will participate within the next 60 days in a face-to-faceinformal mediation (i.e., negotiations) between themselves. Client representatives andadjusters also should be present in person (unless otherwise agreed). Alternatively, theP:\CTMINUTES\Allstatecases\3939.status.wpd 190613.0953parties may engage in formal mediation with a third-party mediator.5. Counsel will exchange lists of suggested mediators who are skilled in insurance coveragecases arising from natural disasters.
