March 1, 2019 Filing 18 Minute entry for proceedings before the Hon. Lee H. Rosenthal. Initial conference held on March 1, 2019. The court found that this case, as one involving intentional discrimination and retaliation against an individual, is not capable of being certified as a class action. Ms. Pruitt agreed to limit her claims to her employment at the Crosstimbers Wal-Mart in Houston, Texas, between June 2018 and February 2019. The court ordered the parties to meet and exchange documents, including the responses to initial disclosures. The court ruled that Ms. Pruitt may depose her immediate Wal-Mart supervisor and a Wal-Mart policymaker; Wal-Mart may depose Ms. Pruitt. The depositions must be held in the courts jury room, Room 11707, and Wal-Mart must provide a court reporter for the depositions. By March 6, 2019, Ms. Pruitt must provide Wal-Mart's counsel with the dates of alleged surveillance tapes showing her clothing and behavior while she was at work. No later than April 1, 2019, Wal-Mart must provide to Ms. Pruitt a copy of any such records that Wal-Mart has of her on those dates. The court denied Ms. Pruitt's pending discovery-related motions based on the current record. If the parties have a discovery dispute, they must contact Ms. Eddins and request a premotion hearing.
