But Valero's Rule 14(c) tender is denied as futile because it is unavailable, as a matter of law, without a Rule 9(h) declaration by Indelpro. Trafigura's motion for a more definite statement is denied in part and granted in part. (Docket Entry No. 26). The motion to sever and transfer and the motion to dismiss will be ruled on separately.
