Valero's proposed third-party complaint is granted as it relates to the new f actual allegations and repetition of its claims against Trafigura. But Valero's Rule 14(c) tender is denied as futile because it is unavailable, as a matter of law, without a Rule 9(h) declaration by Indelpro.
