MINUTE ENTRY and ORDER: Minute entry for proceedings before Judge Charles Eskridge on June 29, 2022. INITIAL CONFERENCE. All parties represented by counsel by video. The Court addressed the scheduling and docket control order and the parties joint discovery/case management plan. Dkts 4 & 9. The Court addressed the motion for summary judgment previously filed by Defendant City of Houston during the state court proceedings. Dkt 1-26. A portion of the statement of relevant facts from the motion was read into the record. See id at 6-7. Counsel to Plaintiff was ADMONISHED that this action is likely frivolous and malicious if the facts as asserted by Defendants are an accurate statement. Counsel to Plaintiff was further ADMONISHED that any sanctions in the form of fees and expenses will be imposed on counsel if this action is ultimately dismissed on a basis concluding that the recited facts were accurate in substantial and meaningful part. To avoid the potential for sanctions, this action must be withdrawn, if desired, by July 11, 2022, or other necessary corrective action taken to bring all prior assertions made in federal court into conformity with Rule 11 of the Federal Rules of Civil Procedure. The motion for summary judgment previously filed by Defendant City of Houston during the state court proceedings was DENIED WITHOUT PREJUDICE to resubmission for reasons stated on the record. Dkt 1-26. Defendant must reassert its motion for summary judgment as against all claims pending in the third amended complaint by July 15, 2022. The Court addressed discovery. Discovery is STAYED pending consideration of Defendants reasserted motion for summary judgment. Plaintiff must specify in any response such discovery as necessary under Rule 56(f).
