For the reasons stated on the record, the Court did not sanction Plaintiff's counsel. Plaintiff's counsel informed the Court that his admission to practice in the Southern District of Texas has lapsed and that he will be immediately seeking reinstatement. MINUTE ENTRY ORDER: The Initial Conference was set for November 9, 2022 (Dkt. No. 3). Plaintiff's counsel Dennis Richard, however, failed to appear at the November 9 hearing. The Court may, on its own motion, issue any just orders if a party fails to obey a pretrial order. Fed. R. Civ. P. 16(f)(1)(c). See Sabre Group, Inc. v. European American Travel, Inc., 192 F.3d 126, 1999 WL 683863, at *1-2 (5th Cir. 1999). The Court may hold a party in civil contempt where there is "clear and convincing evidence that (1) a court order was in effect, (2) the order required specified conduct by the respondent, and (3) the respondent failed to comply with the court's order." United States v. City of Jackson, 359 F.3d 727, 731 (5th Cir. 2004). Plaintiff's counsel Dennis Richard is ORDERED TO SHOW CAUSE why he should not be sanctioned for his failure to comply with the Court's Order by failing to appear at the Initial Conference. In lieu of a show cause hearing, the Court ORDERS Plaintiff's counsel to file his response no later than 5 p.m. on November 11, 2022. SO ORDERED.
