January 5, 2023 Opinion or Order MINUTE ORDER: The Court is in receipt of Defendants' #71 Motion for Leave to File Supplemental Declarations in Support of their Opposition to Plaintiffs' Motion for Preliminary Injunction and #72 Motion for Leave to File a Sur-Reply to Plaintiffs' Motion for Preliminary Injunction. Although Defendants represented that Plaintiffs consented to both motions, Plaintiffs insist in their subsequent #73 Notice that they do not, in fact, consent and intend to file briefing opposing both motions. Plaintiffs evidently argue that in prior communication with counsel for Defendants, attached to the #73 Notice, Plaintiffs consented only to a sur-reply "so long as Defendants do not introduce new evidence in the sur-reply." Additionally, upon review of the parties' communications, Plaintiffs did not affirmatively consent to the filing of amended declarations. That said, it remains unclear whether Plaintiffs nevertheless intended to consent to the filing of amended declarations, particularly because Plaintiffs appear to draw a rather confusing distinction between an "amended" declaration and a "supplemental" declaration. As such, Plaintiffs shall file an opposition to Defendants' #71 and #72 Motions on or before January 6, 2023. Because the parties have filed more than one thousand pages of briefing related to Plaintiffs' #55 Motion for Preliminary Injunction, approximately 850 of which have been filed by Plaintiffs, Plaintiffs' opposition shall not exceed six double-spaced pages. Therein, Plaintiffs shall clarify: (1) whether they intended to consent to "amended" declarations; (2) if they did not, why they did not convey that position to counsel for Defendants; and (3) if they did consent, why the Court should draw any semantic and/or legal difference between an "amended" declaration and a "supplemental" declaration. November 1, 2022 Opinion or Order MINUTE ORDER: The Court is in receipt of counsel Dakin-Grimm's second #26 Notice of Appearance. The Court construes the #26 Notice to be responsive to the Court's October 26, 2022 minute order directing counsel Dakin-Grimm to substantiate representations made to Attorney Admissions. In the #26 Notice, counsel Dakin-Grimm evidently clarifies that she is a "pro bono" member of the Bar of this Court. Attorney Admissions has, in the past, assigned "pro bono" Bar numbers to attorneys representing indigents in certain cases. Currently, pursuant to LCvR 83.2(f), an attorney who is not a member of the Bar of this court may enter an appearance "in any case handled without a fee on behalf of indigents upon certifying that the attorney is providing representation without compensation and is personally familiar with the Local Rules...." An "indigent" is a "poor person" or a "person who is found to be financially unable to pay filing fees and court costs and so is allowed to proceed in forma pauperis."
