MEMORANDUM OPINION AND ORDER OF REMAND - For the reasons stated in III.A, the court concludes that Plaintiff has failed to state claims against Defendants for which relief may be granted under Title VII and the TCHRA. Accordingly, Plaintiff's Title VII and TCHRA claims are DISMISSED WITH PREJUDICE. For the reasons stated in III.B, the court concludes that Plaintiff has failed to state claims against Defendants for violation of her rights to procedural and substantive due process under the Constitutions of the United States and the State of Texas. Accordingly, Plaintiff's claims for violation of the United States and Texas Constitutions are DISMISSED WITH PREJUDICE. For the reasons stated in III.C, Plaintiff's claims for negligence, gross negligence, and intentional infliction of emotional distress asserted under the common law of the State of Texas are REMANDED to the 215th Judicial District Court of HarrisCounty, Texas. Accordingly, Defendants' #6 MOTION for Judgment on the Pleadings Judgment is GRANTED in PART and DENIED in Part...*** STAYED flag cleared...*** Case terminated on 9/26/23.
