Pursuant to Federal Rule of Civil Procedure 65(a)(2), Plaintiff's #11 Motion for Preliminary Injunction is CONSOLIDATED with the trial on the merits. The following schedule and procedure will govern this case. All pleadings and obligations governed by this order will be filed by 3:00 p.m. Central Standard Time on the date ordered. "Days" as used in this order means calendar days, not business days. Defendant will file an Answer and any counterclaims by March 19, 2024, and Plaintiff will answer or reply by March 22, 2024. Paper discovery will be served in seven (7) days. Responses to paper discovery will be served in fourteen (14) days. Since this is an expedited case, the court expects the parties to answer and produce documents and not to file objections. Within twenty-one (21) days. each party may take two (2) depositions, not to exceed four (4) hours each. The Joint Pretrial Order is due twenty-eight (28) days from today. The Joint Pretrial Order may include a memorandum of law, not to exceed ten (10) pages. that discusses potential evidentiary issues. Because none of the issues appear to require an expert witness, no experts will be allowed. There will be no Daubert motions, however labeled, no motions in limine, no motions to dismiss, and no motions for summary judgment.
