| Filing 19 Minute entry for INITIAL CONFERENCE before Judge Charles Eskridge on October 1, 2025. All parties present by video and represented by counsel. The Court addressed the scheduling order and the joint discovery/case management plan. Dkts 8 & 17. The Court addressed the motion by Defendant Anheuser-Busch, LLC, for more definite statement or to abstain or abate. Dkt 12. The status of the related state court proceeding was considered. It was established that the counterclaim in that case by Plaintiff here alleges that the vehicle involved is owned by JB Hunt Transportation, and that it is unknown why Defendant Anheuser-Busch, LLC, is mentioned in the subject police report. It was also noted that (i) the state-court action was filed in advance of this action, and (ii) judgment, if any, in that action would have collateral estoppel effect in this action.The motion was GRANTED as to abatement for reasons stated on the record. It was DENIED WITHOUT PREJUDICE in all other respects. Dkt 12.It is ORDERED that all deadlines are ABATED. This matter is also STAYED and ADMINISTRATIVELY CLOSED. It will be reinstated on the active docket upon motion by the parties after resolution of the other case. A copy of this order must be attached as an exhibit to any motion to reinstate. Plaintiff may bring motion to re-open this action if discovery in the state proceeding reveals an independent basis to hold Anheuser-Busch potentially liable for Plaintiff's injuries. The parties are ORDERED to file a joint status report on March 31st and September 30th of each year going forward, until this matter is dismissed or restored on the docket.
