The Court addressed the motion by Defendant Rob Williams to quash subpoena. Dkt 72. The motion was GRANTED without prejudice to such information being sought through regularly served document requests. The Court addressed the motion by Defendants Houston Crane, Inc, and Noe Munoz to dismiss. Dkt 53. The motion was HELD IN ABEYANCE until briefing is complete. The Court addressed the requests for entry of agreed preliminary injunctions as to Defendants Juan Castillo, Francisco Hernandez, and Josh Wright. Dkts 61, 66 & 69. The requests were GRANTED for reasons stated on the record. The preliminary injunctions will enter separately. The Court addressed the application for preliminary injunction. Dkt 1. Argument heard. Plaintiff's exhibits 1 through 8 offered and admitted without objection. Witness testimony heard from Bryan Scott and Kevin Cohen. Defendants' exhibits 1 through 4 offered and admitted without objection. The application for preliminary injunction was GRANTED IN PART and DENIED IN PART for reasons stated on the record. Dkt 1. It was DENIED as to Plaintiff's theft claims against Defendants Munoz and Houston Crane, LLC. Insufficient evidence of irreparable harm exists to warrant relief. It was GRANTED with respect to the remaining Defendants as to claims respecting non-solicitation provisions within the agreements of the former employees of Plaintiff, as well as with respect to the return of any of its property. It was found that Plaintiff had shown a substantial likelihood of success and irreparable injury in these respects, and that the balance of harms and the public interest favor its position. It was also determined that Plaintiff hadnt met its burden to show a substantial likelihood of success on the merits with respect to the misappropriation of confidential information and trade secrets, beyond electronic evidence or documentary lists that Brandenburg or the other former employees left with upon their exit from employment with Plaintiff. The motion was DENIED in all other respects. Instructions were given to the parties to confer on a draft order for entry modeled on that entered into by consent by Defendant Francisco Hernandez. See Dkt 66. The temporary restraining order was EXTENDED until November 10, 2025, at 11:59 p.m. The parties were ORDERED to confer and file a proposed agreed preliminary injunction by the morning of November 10, 2025, in compliance with the Courts instructions on the record. Counsel for all Defendants were ORDERED to advise their clients of the need to preserve documents and electronic information for discovery and the severe penalties which may result from spoliation.
