| Filing 47 Minute entry for INITIAL CONFERENCE before Judge Charles Eskridge on May 8, 2026. All parties present and represented by counsel. The Court addressed the scheduling order and joint discovery/case management plan. Dkts 24 & 41. The Court addressed the potential for settlement. All parties indicated willingness to engage in further settlement discussions. The Court addressed the motion by Plaintiffs to remand. Dkt 20. It was noted that Defendants PSRG, Inc, CITGO Petroleum Corporation, and CITGO Refining and Chemicals Company, LP, are all Texas entities. Yet the briefing proceeded on argument regarding the forum defendant rule only as to PSRG. See id at 7-9; see also Dkts 36 at 9-11 (response) & 39 at 46 (reply). It was also noted that Turner, a nondiverse defendant, has appeared and answered in this action without moving to dismiss or opposing the motion to remand. See Dkt 42 (amended answer). The motion to remand was TAKEN UNDER ADVISEMENT. Consideration of the pending motions by the CITGO entities and PSRG to dismiss, along with the motion by Plaintiffs for leave to amend, were HELD IN ABEYANCE. See Dkts 7, 16 & 33. The parties were ORDERED to provide further briefing on the potential for remand with respect to (i) the validity of snap removal by a forum defendant, and (ii) the presence of a nondiverse defendant who hasnt moved to dismiss or opposed remand. As to the former, the parties are directed to the decision of Vivas v Boeing Co, 486 F Supp 2d 726, 73435 (ND Ill 2007). Plaintiffs are ORDERED to file a brief of no more than fifteen pages addressing these issues by May 29, 2026. Defendants are ORDERED to file a response brief of no more than fifteen pages by June 19, 2026. Plaintiffs may file any reply of no more than eight pages by June 29, 2026. Further hearing will be set if determined necessary upon review of the briefing. The parties are ADVISED that decision may issue on submission. They may jointly request that such decision be held in abeyance after submission of the briefing, if settlement discussions are then underway and potentially productive.
