| Filing 74 Letter from (Joint) re Scheduling Order. (IACOVANGELO, FRANCESCA) |
Filing 73
TEXT ORDER: The motions at ECF #57 , ECF #59 , and ECF #60 seek dismissal for lack of personal jurisdiction. One of the motions, in the alternative, seeks transfer under 28 U.S.C. 1404. See ECF #59 . But the transfer discussion is terse, and does not meaningfully work through each of the Jumara factors. Cf., e.g., Beychok v. Baffert, 717 F. Supp. 3d 392, 404-11 (D.N.J. 2024) (conducting a full Jumara analysis). Another one of the motions, again in the alternative, also gestures in the direction of transfer --- invoking the common-law forum non conveniens doctrine. See ECF #60 at 15-17. Transfer, in short, is alluded to (to an extent) in some of the Defendants' motions --- though nowhere in a systematic way. But courts are permitted to transfer cases on a sua sponte basis. See Beychok, 717 F. Supp. 3d at 399 n.4 (collecting authorities). And there may be special reason for transfer in cases in which personal jurisdiction over certain defendants seems to present especially complex questions. See, e.g., id. at 405-06. Against this backdrop, the motions at ECF #57 , ECF #59 , and ECF #60 are hereby administratively terminated. Each Defendant shall each file a legal brief of no more than 25 pages as to whether this case should be transferred to the Southern District of Texas, on or before June 13. The Plaintiff shall file a response of no more than 35 pages on or before July 13. Each Defendant may file a reply of no more than 5 pages on or before July 25. So Ordered by Judge Michael E. Farbiarz on 5/12/26. (ro, )

Discovery Confidentiality Order. Signed by Magistrate Judge Jose R. Almonte on 03/18/2026. (aji, )
|
Filing 63
TEXT ORDER: The Court has reviewed the parties' joint dispute letter at Dkt. Nos. #61 - #62 concerning the language and scope of Plaintiff's proposed Discovery Confidentiality Order ("DCO") in this matter. Federal Rule of Civil Procedure 26(c) authorizes courts "to enter a protective order upon a demonstration of 'good cause' in order to protect a party from annoyance, embarrassment, oppression or undue burden or expense." Doe v. Provident Life & Accident Ins. Co., 176 F.R.D. 464, 469 (E.D. Pa. 1997) (citation omitted). "Trial courts are required to apply a standard which balances the private and public interests implicated by the facts of the particular case at bar." Id. at 469 (citing Pansy v. Borough of Stroudsburg, 23 F.3d 772, 787-89 (3d Cir. 1994)). Franchise Defendants' first dispute regarding the language referenced in paragraph three is DENIED. The DCO shall include the language "or other information that could be used to identify," as the Court does not find this language impermissibly broad, vague, or unduly restrictive considering the sensitive nature of this case. Further, it is self-explanatory that "photographs or images of" Plaintiff would be included within the definition of "other information that could be used to identify" Plaintiff. Next, Franchise Defendants' second dispute over paragraph 9(j) is DENIED for the reasons set forth in the Court's comprehensive decision on this issue in P.B. v. Wyndham Hotels & Resorts, Inc., 750 F. Supp. 3d 484 (D.N.J. 2024). Accordingly, for good cause shown under Federal Rule of Civil Procedure 26(c), the Court will enter the operative DCO in this matter at Dkt. No. 61-1.So Ordered by Magistrate Judge Jose R. Almonte on 3/18/2026. (akw, )

The briefing schedule for the forthcoming motions to dismiss are adopted as follows: any and all jurisdictional motions to dismiss shall be filed on or before February 27, 2026; opposition briefs to the jurisdictional motions to dismiss shall be filed on or before March 30, 2026; and reply briefs shall be filed on or before April 20, 2026. Further, no later than March 2, 2026, the parties shall separately file an agreed-upon proposed Confidentiality Protective Order, or a position letter if an agreement on the same cannot be reached. In that regard, the Court notes that this Court recommends the use of the proposed order found at Appendix S of the Local Civil Rules. The parties should be guided accordingly. TEXT ORDER: The Court orders the parties to move forward with written discovery notwithstanding the defendants' forthcoming motions to dismiss for lack of personal jurisdiction; therefore, the defendants' participation in discovery pursuant to this Order does not waive that party's right to raise a defense for lack of jurisdiction. Oki Data Americas, Inc., 247 F.R.D. 453, 454 (D.N.J. 2007) (Magistrate Judges have broad discretion to manage their docket and to decide discovery issues, including whether to stay discovery pending a decision on a dispositive motion). TEXT ORDER: In light of the Court's ruling at ECF #35 , jurisdictional discovery will now go forward under the supervision of the United States Magistrate Judge. That discovery will presumably be quite narrow, and therefore should not take long. Until jurisdictional discovery is closed, and any follow-on Rule 12(b)(1) motion practice is resolved, it will not be clear who the parties are to this litigation. The Court will not resolve the pending motion to dismiss, at ECF #11 , until the line-up of the parties is solidified. Therefore, the ECF #11 motion is administratively terminated. It will be placed back onto the Court's active docket when the threshold jurisdictional issues here are resolved. The Plaintiff and Defendant Om Krupa Maa shall file a brief joint status update letter as to the progress of jurisdictional discovery, and as to whether Om Krupa Maa will file a renewed Rule 12(b)(1) motion. The letter shall be brief, and shall be filed on October 3.. SO Ordered by Judge Michael E. Farbiarz on 8/25/2025. (ro, )
