MEMORANDUM AND ORDER denying 32 Motion for Summary Judgment; denying as moot 41 Motion to Supplement Motion for Summary Judgment; denying 29 Motion for Summary Judgment and Motion to Dismiss. For reasons stated above, the Court on its own moti on DISMISSES the following: Madero's equitable estoppel counterclaim; Madero's negligent representation counterclaim; Somero's money-had-and-received-claim; Somero's Negligent misrepresentation claim; Somero's conversion clai m; and Somero's laches defense.
