MINUTE ENTRY for proceedings held before Magistrate Judge Diana Song Quiroga. INITIAL PRETRIAL AND SCHEDULING CONFERENCE held on 7/24/2019. Plaintiff appeared through counsel Doanh The Nguyen. Defendant appeared through counsel Inez M. McBride. The Court then summarized the procedural history of this FLSA case. Defense Counsel noted that the certification of the class is likely to be a contested issue. All Parties agreed that many of the deadlines turn upon whether an anticipated motion for class certification is granted, conditionally granted, or denied. Counsel agreed to hold a status conference with the Court two weeks after the District Court rules upon the motion for class certification, at which point additional scheduling order deadlines will be set. A scheduling order with the current agreed upon dates will be issued shortly. The Court also encouraged Counsel to confer as to whether a protective order would be appropriate at this stage. The Court, finally, highlighted District Judge Marina Garcia Marmolejo Civil Court Procedures which are available on the Court website and emphasized the importance of conferring before filing opposed motions, and of providing the Court with prompt notification of settlement. The Court monitors its docket very actively and will endeavor to assist the parties with genuine disputes. Agreements to continue any deadlines are not binding on the Court. Requests for continuances must be made at least three days in advance of the controlling deadline. The Court will remain cognizant of the Parties needs and encouraged the Parties to keep the Court apprised of any developments. Telephonic Attorney Appearances: Doanh The Nguyen f/PLAINTIFF; Inez M. McBride f/DEFENDANT. (2:36 - 3:02) (ERO: Robert Tenorio) (IBruce, 5) |
