Minute Entry for proceedings held before Magistrate Judge John A. Kazen. MOTION HEARING held on 8/8/2019 on Defendant Nationwide Property and Casualty Insurance Company's Unopposed Motion to Substitute Scottsdale Insurance Company as Defendant and to Amend the Case Caption. (Dkt. No. 5). The Court confirmed with the parties that the intent of the motion was to dismiss current defendant Nationwide as a defendant and to join Scottsdale Insurance Company as a new defendant due to Plaintiff having sued the wrong company. Defense Counsel confirmed that his firm would represent Scottsdale and that Scottsdale would not raise any legal challenges to being named as a defendant. The Court suggested that the proper process to achieve this would be for Plaintiff to file an amended complaint naming Scottsdale as a defendant and for the parties to file a joint stipulation of dismissal as to Plaintiff's claims against Defendant Nationwide. The parties agreed. The Court, having found good cause, GRANTED Plaintiff leave to amend the complaint. The Court requested that the parties file the amended complaint and joint stipulation of dismissal no later than 8/12/2019 and to file an advisory with the Court if any party raises concerns.
