MEMORANDUM AND OPINION. The motion to dismiss is GRANTED IN PART and DENIED IN PART. Plaintiffs Section 1983 claims against Sheriff Cuellar in his official and individual capacity, Section 1983 unconstitutional policy claim and failure-to-train-or-su pervise claim against Webb County, and wrongful death claim under the TWDS are DISMISSED WITH PREJUDICE. However, the following claims remain pending: Plaintiffs Section 1983 claims against the Jailer Defendants in their individual capacities and her TTCA wrongful death claim against Webb County.
