Minute Entry for proceedings held before Magistrate Judge Diana Song Quiroga. Initial Scheduling Conference held on 10/20/2021. Plaintiff appeared via Zoom through counsel Leticia Garza, and Defendants appeared via Zoom through counsel Hunter Fugate. As an initial housekeeping matter, the Court instructed Defendant's counsel to file a notice of appearance by the end of the day. Defendant's counsel also clarified that he is representing Defendants Defendants Tycyznski, TPine Leasing Capital LP, and National Freight Ltd. Foreign Defendants Tycyznski and Pride Group Ltd. have not yet been served. The parties will also engage in target discovery to determine whether service to Defendant Pride Group Ltd. is necessary. The Court instructed Plaintiffs to amend their pleadings with respect to named parties by December 3, 2021. The Court held an initial scheduling conference. Plaintiff has not yet exchanged initial disclosures with Defendant, and the Court asked Plaintiff to do so by the end of day. The Court reviewed the proposed scheduling order. Due to issues with serving foreign parties and Plaintiffs potential need to amend the pleadings, the Court agreed to enlarge deadlines accordingly. The parties agreed to the deadlines. Finally, Defendants brought to the Court's attention their recently filed motion for leave to amend the notice of removal. (Dkt. No. 6.)The Court emphasized the importance of conferring in good faith before filing opposed discovery motions, and of providing the Court with prompt notification of settlement. The Court will issue a scheduling order with dates agreed upon by the parties, as well as an order on the motion for leave to amend.
