REPORT AND RECOMMENDATIONS: Recommends that Pltf's claims re: the return of property be dismissed w/out prejudice to filing an amended cmp in Cause No. A-09-cv-152-LY. FURTHER RECOMMENDS that Pltf's Bivens claims brought against Defendants Henderson and Martinez be dismissed w/prejudice as frivolous pursuant to 28 U.S.C. section 1915(e). FURTHER RECOMMENDS that the Court include w/in its judgment a provision expressly and specifically warning Pltf that filing or pursuing any further frivolous lawsuits may result in sanctions...
