ORDER GRANTING IN PART AND DENYING IN PART 23 Motion for Summary Judgment. Summary Judgment is DENIED as to Defendants Murphy and Johnson. Summary Judgment is GRANTED as to Defendant Nelson; GRANTING 25 Motion for Summary Judgment.
