ORDER GRANTING 49 Defendant's Motion for Summary Judgment; GRANTING 51 Defendant's Motion to exclude testimony; DENYING 52 Plaintiff's Motion for Sanctions. All claims against NISD and Aslin are dismissed. The state tort claims a nd section 1983 claims against Martinez remain pending. Defendant Martinez never filed an answer in this case and Plaintiffs have not sought a default judgment.
