The Clerk shall VACATE the Courts order granting summary judgment (docket no. 14), the judgment (docket no. 15), and the abstract of judgment (docket no. 16), and shall reinstate Plaintiffs motion fo r summary judgment (docket no. 13) as a pending motion. Defendant is ordered, no later than June 13, 2012, to file a response to Plaintiffs original Motion for Summary Judgment, at which point the Court will reconsider the Motion for Summary Judgment. Defendant is ordered to pay Plaintiffs expenses incurred in filing a release of its Abstractof Judgment, and file an Advisory reflecting he has done so no later than June 13, 2012.
