MEMORANDUM OPINION AND ORDER, That Encana's motion to dismiss [Doc No. 8] is GRANTED in part and DENIED in part. The motion to dismiss [ECF No, 8] is GRANTED with respect to LBI-I's causes of action for breach of contract related to royalty payments, violations of the TEXAS NATURAL RESOURCES CODE, and declaratory judgment. The motion is DENIED with respect to LBH's causes of action for breach of contract related to accounting and LBH's claim for attorney's fees. Because LBH's amended complaint was considered in this opinion, LBH's motion for leave [Doc No. 13] is GRANTED; LBH's motion to continue on response [Doc No. 14] is DENIED as moot. A separate Order consistent with this Memorandum Opinion was previously issued, Doc #30, Signed by Judge Royce C. Lamberth. (wg)
