Filing 4 ORDER DENYING #2 Motion to Appoint Counsel. Petitioner is warned that his current motion for counsel (ECF No. 2) and attached pleadings (ECF No. 1) are not construed as an application for habeas corpus relief filed pursuant to 28 U.S.C. 2254and have no effect on the limitations period imposed by 28 U.S.C. 2244(d) of the AEDPA. Should Petitioner choose to file a 2254 application for habeas corpus relief pro se, he may do so by clearly and concisely stating his allegations and relief sought on the forms provided within thirty (30) days of the filing of this Order. The Clerk of the Court shall forward to Petitioner the correct forms for filing a federal habeas application pursuant to 28 U.S.C. 2254. If Petitioner chooses to file an application for writ of habeas corpus, he must either: (1) submit to the Court the required filing fee of $5.00 along with the 2254 application, or (2) file a completed application to proceed in forma pauperis (IFP) along with a current institutional trust fund account statement showing deposits and balances to Petitioners institutional account for the previous six months. A trust fund account statement should be provided to Petitioner by the law library where Petitioner is incarcerated.
