Further, having fully re viewed the Magistrate Judges Report and Recommendations, the relevant case law, and the record in this case, the Court finds that it should be adopted for the reasons stated therein. The Court therefore ORDERS that the Report and Recommendation of th e United States Magistrate Judge (Dkt. 23) is APPROVED AND ACCEPTED.
