Filing 68 MEMORANDUM DECISION AND ORDER- IT IS HEREBY ORDERED that: (1) Plaintiffs Motion for Subpoena Duces Tecum or Appointment of Counsel (Dkt. no. 66) is DENIED; (2) Defendant Carlsons Motion to Dismiss (Dkt. no. 27) is GRANTED; (3) Defendant Georges Moti on to Dismiss (Dkt. no. 31) is GRANTED; (4) Defendant Ottos Motion for Summary Judgment (Dkt. no. 43) is GRANTED;(5) Plaintiffs Motion for Partial Summary Judgment against Defendant Otto (Dkt. no. 38) is DENIED; and, (6) the Clerks Office shall provi de a copy of this Memorandum Opinion and Order to the Utah Attorney Generals Office for review, in light of this opinion and relevant caselaw, of Utah Department of Corrections contracts for provision of legal services to inmates. (2) The USMS shall serve a completed summons, a copy of the Complaint and a copy of this Order upon the above-listed remaining defendants. (3) Within twenty days of service, Defendants must file an answer or motion to dismiss and proposed order, as stated above. (4) If filing (on exhaus tion or any other basis) a Martinez report with a summary judgment motion and proposed order, Defendants must do so within sixty days of filing their answer(s). (5) If served with a Martinez report and a summary judgment motion or motion to dismiss, Plaintiff may file a response within thirty days.
