ORDER GRANTING IN PART AND DENYING IN PART #58 Motion for Leave to File. Defendants move for leave to file a supplemental submission presenting new evidence and offering new arguments based on case law that was available at the time of the trial. It is improper for Defendants to file a post-trial motion "to introduce evidence that was available at trial but was not proffered, to relitigate old issues, [or] to advance new theories[.]" United States v. Loc. 1804-1, Int'l Longshoremen's Ass'n, 831 F. Supp. 167, 169 (S.D.N.Y. 1993), aff'd sub nom. United States v. Carson, 52 F.3d 1173 (2d Cir. 1995) (quoting Fontenot v. Mesa Petroleum Co., 791 F.2d 1207, 1219 (5th Cir. 1986)). However, the court has discretion to grant Defendants permission to submit additional factual evidence relevant to the court's determination. See Fed. R. Civ. P. 52(b); Sequa Corp. v. GBJ Corp., 156 F.3d 136, 143 (2d Cir. 1998). Because of the limited record in this case, the court GRANTS IN PART Defendants' motion for leave to file a supplemental submission to the extent Defendants present new evidence regarding when newly filed complaints that are not made publicly available on the date of filing become accessible and DENIES IN PART Defendants' motion for leave to file a supplemental submission to the extent it presents new arguments based on case law which predates the trial.
