November 13, 2003 Opinion or Order Filing 24 JUDGMENT AND PERMANENT INJUNCTION this Court has jurisdiction over the parties and the subject matter of this civil action, and venue is proper in this district. Deft. Pro Cuttery, Inc. and its agents, employees, servants, officers, directors, successors in interest, heirs, assigns and all persons, firms or corporations, acting by or under their authority, in active concert of privity or in participation with them, is enjoined from using the registered Cuttery Marks in any way and any word, words, phrases, symbols, logos, etc. which would create a likelihood of confusion, mistake or deception therewith, including without limitation the Infringing Marks, in connection with or in the marketing, offering, selling, disposing of, licensing, leasing, transferring, displaying, advertising, reproducing, developing or manufacturing of their business, services and products. All claims, defenses, and counterclaims between Creative Hairdressers, Inc., Pro Cuttery, Inc. and Christine Dean, presented in this action, however denominated, are hereby dismissed with prejudice. Each party shall bear its own attorneys' fees, costs, and expenses. The Settlement Agreement entered into by the parties is an express condition to this Order, and the Court maintains jurisdiction over the Settlement Agreement, the parties and the subject matter for the purposes of enforcing this Judgment (See Order for Details) (Signed by Judge Claude M. November 13, 2003 Opinion or Order Filing 23 Stipulated Order, that this case is dismissed with prejudice All claims set forth in the above-captioned civil action shall be dismissed with prejudice against defendant Dean pursuant to the terms of and subject to the conditions set forth in the Settlement Agreement entered into by and between the parties; and there shall be a judgment and a permanent injunction entered against defendant Pro Cuttery in the form of the Judgment attached hereto; and compliance with the terms of the Settlement Agreement executed by the parties is a condition of this consent stipulation for entry of judgment.
