ORDER For the reasons stated in the accompanying Memorandum Opinion, the U.S. Patent and Trademark Office's denial of Pltf's patent term extention application is VACATED and this case is REMANDED to the PTO for reconsideration as to the dat e of approval under 35 USC 156. It is further Ordered that the US PTO take such actions as necessary to ensure the '404 patent does not expire pending resolution of these proceedings. (Signed by District Judge Claude M.
