March 9, 2020 Opinion or Order MINUTE ORDER. In its #8 Motion to Transfer Venue, the government purports to move under 28 U.S.C. Sec. 1404(a). But the government's motion, the plaintiff's response, and the government's reply focus on whether the District of Columbia is an appropriate venue at all--regardless of whether the case could or should have been brought in the Eastern District of Virginia. Thus, the parties appear to be treating this motion primarily as one to transfer venue under 28 U.S.C. Sec. 1406(a). The government shall file a notice clarifying, on or before March 11, 2020, whether this motion is proceeding under 1404(a), 1406(a), or both. After receiving the notice, the Court will determine whether additional briefing is needed. So Ordered by Judge Dabney L. Friedrich on March 9, 2020.
