ORDERED that this action be and is DISMISSED WITHOUT PREJUDICE to later renewal. Specifically, if Lowe is successful in reversing the criminal charge against him through a judgment in the state court system, he may initiate a new federal civil action seeking damages for his wrongful incarceration. If he is not successful and seeks to challenge the state courts rulings with respect to the legitimacy of his incarceration, Lowe may use the attached form tofile a petition for writ of habeas corpus in this Court; and it is further ORDERED that Lowes Petition of Release [Dkt. No. 5] be and is DENIED WITHOUT PREJUDICE; and it is further ORDERED that Lowes motion for leave to proceed in forma pauperis [Dkt. No. 2] and for appointment of counsel [Dkt.
