November 23, 2021 Opinion or Order Filing 4 ORDERED that the claims against Harold Clarke, Warden Walrath, and Unit Manager Mr. Vancampen be and are DISMISSED. It is further ORDERED that plaintiff is permitted to file an amended complaint within thirty (30) days of the date of this Order. It is further ORDERED that if an amended complaint is not received within thirty (30) days from the date of this Order, the Court will dismiss this civil action pursuant to 28 U.S.C. 1915A(b)(1) and direct the Clerk of the Court to record the dismissal for purposes of the Prison Litigation Reform Act. Plaintiff is advised that the dismissal may affect plaintiff's ability to proceed in forma pauperis in future civil actions. It is further ORDERED that plaintiff is assessed a filing fee of $350.00 and an administrative fee of $52.00, pursuant to 28 U.S.C. 1914(a). It is further ORDERED that plaintiff's motion for leave to proceed in forma pauperis [Dkt. No. 2] be and is conditionally granted to the extent that plaintiff need not prepay the filing fee at this time. If the Court grants the motion, plaintiff will be required to pay the filing fee in installments after first paying an initial filing fee, and the $52.00 administrative fee will be waived.
