ORDERED that the Consent Motion for an Order Setting Briefing Schedule #23 is GRANTED; it is further ORDERED that no later than September 11, 2023, Defendant The BD Listing, LLC ("BDL") shall submit a supplemental brief, not to exceed 10 pages, on the question whether BDL has met its burden to establish that Michael Lloyd had authority from Plaintiff MOMENTUMcorp, LLC ("Momentum") to contract on its behalf when Lloyd signed the Referral Agreement; it is further ORDERED that no later than September 25, 2023, Momentum shall submit a response, not to exceed 10 pages; it is further ORDERED that no replies are permitted except upon leave granted by the Court; and it is further ORDERED that, after reviewing the supplemental briefing, the Court will determine whether a further hearing is necessary, and if not, will decide the question presented on the papers.
