MEMORANDUM OPINION AND ORDER that the court GRANTS in part defendant A. L. Anderson's Motion to Dismiss, and DISMISSES Counts 1, 2, and 3 against defendant A. L. Anderson in his official capacity, and Count 2 against defendant A. L. Anderson in his individual capacity. Unless plaintiff submits an amended complaint sufficiently pleading "severe emotional distress" within 10 days of the date of this Memorandum Opinion and Order, the court will dismiss Count 3 against defendant A. L. Anderson in his individual capacity. The court DENIES defendant A. L. Anderson's Motion to Dismiss in regard to Count 1 against defendant A. L. Anderson in his individual capacity.
