Filing 97 OPINION AND ORDER: For the reasons set forth in this Opinion and Order, Claimant's Rule 56(d) motion for additional time to complete discovery is DISMISSED AS MOOT. Claimant's 64 Motion for Summary Judgment is DENIED, and Plaintiff 39;s 29 Motion for Summary Judgment is GRANTED. The trial scheduled to commence on Tuesday, April 8, 2014, will be limited to the following "triable issues" indicated in the March 27, 2014 final pretrial order: "the total amount due to Plaintiff for which it has a maritime lien on the Vessel," "whether Plaintiff is entitled to prejudgment interest," and "whether Plaintiff is entitled to administrative charges, custodian legis expenses, attorney fees and inte rest." ECF No. 85 at 21; see Triton Marine Fuels, Ltd. v. M/V PACIFIC CHUKOTKA, 671 F. Supp. 2d 753, 760 (D. Md. 2009) (citing Bradford Marine, Inc. v. M/V SEA FALCON, 64 F.3d 585, 589-90) (observing that "an FMLA lien does not necessarily cover all the terms of the underlying contract"), as outlined.
