The Court withholds ruling on the additional question of Flame's pleading that FBP is the corporate alter ego of ICI. However, considering the complexities and unce rtainties involved in this case and the importance of clarifying the procedural issues presented, the Court CERTIFIES this matter for expedited appeal to the Fourth Circuit. The Court further recommends that the parties are able to present an appeal on the existing record and that there may be no need for oral argument. IT IS SO ORDERED.
