MEMORANDUM ORDER Granting 3 Motion to Dismiss for Failure to State a Claim. The Court GRANTS Defendants' Motion to Dismiss Plaintiffs' Complaint, ECF No. 3, and Plaintiffs' Complaint is DISMISSED WITHOUT PREJUDICE to Plaintiff s' right to file a formal motion seeking leave to file an amended complaint. If Plaintiffs elect to file a motion to amend, it shall be filed no later than twenty-one (21) days after the entry of this Memorandum Order, and should be accompanie d by a supporting brief, which includes as an exhibit Plaintiffs' proposed amended complaint. If Plaintiffs elect not to pursue amendment within this time period, the dismissal of Plaintiffs' Complaint shall become a dismissal with prejudice. Signed by District Judge Mark S.
