MEMORANDUM ORDER re: 29 Report and Recommendations.; 15 Motion to Dismiss for Failure to State a Claim. This court, having examined the Objections to the Magistrate Judge's R&R, and having made de novo findings with respect thereto, OV ERRULES the Defendant's Objections and hereby ADOPTS and APPROVES in full the findings of fact and recommendations set forth in the R&R of the United States Magistrate Judge filed on October 4, 2016. ECF No. 29. Accordingly, the court DENIES the Defendant's Motion to Dismiss filed on August 23, 2016. ECF No. 15.
