October 4, 2018 Opinion or Order Filing 2 MEMORANDUM ORDER that: 1. The petition is CONDITIONALLY FILED; 2. The Clerk is DIRECTED to mail Petitioner the standardized form for filing a 2254 petition; 3. The Clerk of the Court is DIRECTED to process Petitioner's request to proceed in forma pauperis. If an appropriate affidavit for proceeding in forma pauperis has not been submitted, the Clerk shall mail an appropriate in forma pauperis affidavit to Petitioner. Failure of Petitioner to complete and return the in forma pauperis affidavit or pay the $5.00 filing fee within fifteen (15) days of the date of entry hereof will result in dismissal of the action. The Clerk shall obtain a certified copy of Petitioner's trust account for the six (6) month period immediately preceding the initiation of this action (please see Memorandum Order for additional information.) 11. Petitioner should only return this form if Petitioner consents to the jurisdiction of the United States Magistrate Judge.
