MEMORANDUM ORDER that the petition is CONDITIONALLY FILED pending payment of any assessed filing fee; the Clerk is directed to process Petitioner's request to proceed in forma pauperis; if an appropriate in forma pauperis affidavit for proceedings in forma pauperis has not been submitted, the Clerk shall mail an appropriate in forma pauperis affidavit to Petitioner; failure of Petitioner to complete and return the in forma pauperis affidavit or pay the $5.00 filing fee within fifteen (15) days will result in dismissal of the action; the Clerk shall obtain a certified copy of Petitioner's trust fund account for the six (6) month period immediately preceding the initiation of this action; and, the Clerk is DIRECTED to send Petitioner a Notice & Consent to Proceed Before a United States Magistrate form (please see Memorandum Order for additional information).
