ORDER that this matter comes before the Court on the pro se plaintiff's motion for leave to proceed in forma pauperis. (Dk. No. #1 .) Upon consideration of the motion and the financial affidavit the plaintiff submitted in support of his motion, the Court finds that the plaintiff's and his spouse's income during the past 12 months are sufficient to enable the plaintiff to pay the costs of this litigation. Accordingly, the Court DENIES the motion for leave to proceed in forma pauperis. The Court DIRECTS the plaintiff to pay the $400.00 filing fee by March 28, 2019, or the Court will dismiss this case without prejudice. It is so ORDERED. Signed by District Judge John A.
