Filing 4 MEMORANDUM ORDER that this matter is before the Court on Christopher Dolin's (pro se "Plaintiff') Application to Proceed In Forma Pauperis ("IFP"), filed on August 1, 2019 (ECF No. 1 ). The Court concludes that Plaintiff is unable to pay the required fees, and therefore, Plaintiff's Application to Proceed In Forma Pauperis hereby GRANTED. Plaintiff may proceed in this case without paying the Court's filing fee, and the Court DIRECTS the Clerk to file Plaintiff's Complaint. For the reasons set forth below, however, the Court finds that Plaintiff's Complaint fails to state a claim on which relief may be granted. Accordingly, the Court DISMISSES Plaintiff's complaint pursuant to 28 U.S.C. 1915(e)(2)(B)(ii) (please see Order for additional information.) Therefore, the Court GRANTS Plaintiff's Application to Proceed In Forma Pauperis but DISMISSES Plaintiff's Complaint WITHOUT PREJUDICE. Plaintiff is free to amplify the factual and legal bases upon which his claim rests and then refile with this Court. Furthermore, based on the Complaint's failure to state a claim, the Court certifies that an appeal in forma pauperis would not be taken in good faith pursuant to 28 U.S.C. 1915(a)(3). Thus, Plaintiff's in forma pauperis status is hereby REVOKED for the purpose of appeal. It is so ORDERED. Signed by District Judge Henry E. Hudson on 09/12/2019. Copy mailed to Plaintiff. (walk, ) |
